By purchasing the right to use the digital content and if you do proceed to use this digital content ( referred to as: digital content, digital files, designs, items, graphics, fonts, software, plugins, resources ) you are deemed to have read and fully accepted the licence agreement and terms and conditions and acknowledge that you will lose your right of withdrawal from the contract once the download or streaming of the digital content has begun. If you do not agree with this licence agreement and terms and conditions, we will not license the digital content ( referred to as: digital content, designs, items, graphics, fonts, software, plugins, resouces ) to you and you must discontinue the use of the digital content ( referred to as: digital content, designs, items, graphics, fonts, software, plugins, resouces ). The terms of this licence include, in particular, limitations on liability. The digital content provided are reserved for individuals who are at least 18 years old or minors who have parental consent to use this digital content ( referred to as: digital content, digital files, designs, items, graphics, fonts, software, plugins, resources ). Creator.Design can from time to time change these Licence, terms and conditions without any further notice.
As part of our commitment to high-quality service, we believe it is important to have a clear understanding with you regarding our respective obligations. this licence agreement and terms and conditions constitute the legal agreement between you, the client (referred to as "client" or “you" or ”licensee”), and Creator.Design a division of Tyche Creation ltd. All digital content ( referred to as: digital content, digital files, designs, items, graphics, fonts, software, plugins, resources ) are protected by United States and international copyright laws and treaties. Creator.Design a division of Tyche Creation ltd. owns all rights, including, without limitation, all copyright and other intellectual property rights relating to the digital content ( referred to as: digital content, digital files, designs, items, graphics, fonts, software, plugins, resources ).
All copyright and other intellectual property rights relating to photos or other designs used in the digital content remain the property of their respective owners. No claim or action of any sort can arise against Creator.Design a division of Tyche Creation ltd. in the agreement for the use of these assets no liability can attach to "Tyche Creation ltd." for any acts, omissions or failures on the part of the terms.
Creator.Design hereby grants you a non-exclusive, non-transferable right to use, modify and reproduce the digital content ( referred to as: digital content, digital files, designs, items, graphics, fonts, software, plugins, resources ) as expressly permitted by the license.
Personal Use is defined as using purchased digital content in a manner that has no potential monetary gain. Personal Use projects cannot be related to any business, non-profit, or other organization of any kind. All purchased digital content may be used in an unlimited number of Personal Use Projects. Examples of Personal Use include using a graphic to create t-shirts for a family reunion, using a template to create a birthday card that you send in celebration of a friend's special day, using a photo in a piece of wall art that you create for family member as a gift (no money changes hands), etc.
We define Commercial Work or Commercial Project to be any work done that is not for Personal Use. Synonymous terms include Contracted Work and Client Work.
You may use a purchased digital content in a new End Product as long as the End Product meets the following requirements. End Products must be significantly different than the original digital content and require time, effort, and skill to produce. You must combine the digital content with other creative elements to form a new original design.
The purchased digital content may not be used as is and the end products must not be used or sold in a way that is directly competitive with the original digital content you purchased. End Products must not redistribute the original digital content to any third parties in a manner that allows for the extraction of the original digital content. An End Product For Sale can be either a digital design or physical item that you and/or your client intend to sell to more than a single person for any type of fee or charge, but ensuring that no third parties are able to extract the original resource.
A purchased digital content may be used in one Project. Standard Licence includes using the digital content for One Commercial Project, which you design for yourself or your client. A Project* is defined as a complete and cohesive undertaking that may result in one or more End Products. Any End Products included in the one Project must be directly related under a single concept. ( example of One Project with many End Products would be a business brand image suite that includes stationery, letterhead, business card, website, envelope, etc. ).
Personal use: You may use the digital content in as many personal projects as you like. - You may modify or manipulate the Item, or incorporate it into other content and make a derivative work from it. - You may use the purchased digital content for One Commercial Project*. - The digital content purchased under the Standard License may be used to create End Products for Sale where lifetime sales of the End Product for Sale do not exceed 500 units. ( example: books, magazines, newspapers, editorials, newsletters, advertising and promotional projects, including printed materials, product packaging, presentations, catalogs, brochures, promotional greeting cards, promotional postcards ). - You may use purchased digital content in multimedia projects, TV, films, streaming video, on demand broadcasts, film, video presentations, commercials, theatrical presentations and/or online videos for up to 10,000 views per month and internet banners and website graphics up to a maximum of 1000 x 1000 pixels;
The Extended Licence allows you to use the digital content in any manner permitted under the Standard Licence, and pursuant to the obligations and restrictions therein. The digital content purchased under the Extended License may be used to create End Products for Sale that may be sold an unlimited number of times.
How many times can I use the purchased digital content for commercial projects? - 1(one) Project
How many times can I use the graphics in personal projects? - Unlimited Projects
Can I modify purchased digital content? - Yes
Can I buy an Extended License for digital content already purchased? - Yes
Can I convert a purchased website template into an HTML website or theme for myself or a client? - Yes
Can I use the digital content as is, as a primary logo mark for an organisation? - No
Can I deconstruct the graphic, repackage and resell the individual parts? - No
Can I use the digital content on their own and not part of a wider original design? - No
Can I turn the digital content into a repeating pattern/texture/other design resources for resale in a new format? - No
Can I provide my client with the source files for purchased digital content ? - No
You are aware and fully agree that you can not sublicense, resell, share, transfer, distribute or otherwise redistribute the digital content files, directly or indirectly on the internet or in any medium, under any circumstances, not even for free. You may not make the Item available on a digital asset management system, shared drive, or the like for the purposes of sharing or transferring the Item, and you must not permit an end user of the end product to extract the Item and use it separately from the End Product. You agree to take all commercially reasonable steps to prevent third parties from accessing and/or duplicating the Item. You may not use any Item in a way that violates the Agreement including, without limitation, in a manner that infringes any third party's trademark or other intellectual property, or would give rise to a claim of deceptive advertising or unfair competition. Items that contain digital images of real products, trademarks or other intellectual property owned by third parties may require clearance from the rights owner. It is your responsibility to consider whether your use of these Items requires a clearance and if so, to obtain that clearance from the rights owner. You may not register as a trademark the Item or the end product incorporating the Item – not even logos. If you use the Item to create a logo for yourself or a client, keep in mind that third parties can use the Item too, even in another logo.
You may not use any Item if that use could result in a third party’s claim that it acquired rights in the Item that are contrary to this license. You shall immediately remove the Item from any unauthorized location or use, including an unauthorized social media platform or website.
You may not falsely represent, expressly or by way of reasonable implication, that any Item was created by you or a person other than the copyright holder(s) of that Item. If you use the Item for editorial purposes (print, web or tv) you have to include the credit adjacent to the product: Creator Design: http://creator.design You may not use Item(s) containing models and/or property in a manner that is unlawful, harmful, abusive, racially or ethnically offensive, defamatory, deceptive, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, obscene, threatening, profane, or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual, or is otherwise objectionable.
All digital content ( referred to as: digital content, designs, items, graphics, fonts, software, plugins, resources ) are provided "as is" without warranty of any kind, either express or implied, including, but not limited to the implied warranties of non-infringement, merchantability, or fitness for a particular purpose. Creator.Design does not warrant that the digital content ( referred to as: digital content, designs, items, graphics, fonts, software, plugins, resources ), Creator.Design websites, or other materials or services ("Creator.Design products or services") will meet your requirements or that use will be uninterrupted or error free. The entire risk as to the quality, performance and use of the Creator.Design Products or Services is solely with you.
If you breach any of the terms of the Agreement, the license can be terminated, in addition to Creator.Design's other rights at law and/or equity. If that happens, you must stop making copies of or distributing the End Product until you remove the digital content from it. Creator.Design shall be under no obligation to refund any fees paid by you in the event that your account is terminated by reason of a breach.
If you create the End Product for a client, your client must comply with these License Terms.
This Agreement constitutes the entire agreement between you and Creator.Design, concerning your use of the digital content. If any provision of the Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of that part of the Agreement shall not affect the validity of the remaining provisions of the Agreement, which shall remain in full force and effect. If there is an inconsistency between the terms of the License Terms, the License Terms will apply to the extent necessary to resolve the inconsistency.
